Introduction
These Terms of Service (“Terms”) govern your access to and use of the Kazi mobile application, website, products, and related services collectively referred to as the “Service.”
Kazi is an AI-powered image, video, photo editing, and outfit preview application. The Service allows users to generate images and videos, upload photos or videos for AI editing, preview outfit styles, replace backgrounds, adjust visual styles, and create visual content using Kazi AI.
By accessing or using Kazi, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use Kazi. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.
By using the Service, you represent that you meet the applicable age requirements and have the legal capacity to enter into these Terms.
2. Account Registration and Login
Kazi may allow users to access the Service through Google Sign-In, Sign in with Apple, or guest quick login.
When you create or access an account, you agree to provide accurate and complete information and to keep your account information secure.
You are responsible for all activities that occur under your account. If you believe your account has been accessed without authorization, please contact us at [email protected].
Guest Login
Kazi may provide guest quick login for convenient access. Guest accounts may have limited functionality. Data associated with a guest account may be lost if you uninstall the App, clear local data, change devices, or fail to bind the guest account to another login method.
Kazi is not responsible for loss of guest account data caused by device changes, app deletion, local data deletion, or failure to connect the guest account to a permanent login method.
3. Description of Service
Kazi provides AI-powered creative tools, which may include:
The availability of specific features may vary depending on your device, region, account type, app version, subscription status, or technical conditions.
We may modify, update, suspend, or discontinue any part of the Service at any time, with or without notice.
4. User Content
“User Content” means any content you upload, submit, generate, edit, save, export, or otherwise make available through the Service, including photos, videos, images, outfit references, text prompts, editing instructions, generated images, generated videos, and other creative materials.
You retain any rights you may have in your User Content. Kazi does not claim ownership of your uploaded content.
By using the Service, you grant Kazi a limited, non-exclusive, worldwide, royalty-free license to process, host, store, reproduce, modify, create derivative outputs, display, and transmit your User Content solely as necessary to provide, operate, maintain, secure, and improve the Service, including AI generation, editing, video creation, outfit preview, saving, exporting, support, abuse prevention, and legal compliance.
Kazi does not use your uploaded photos, videos, prompts, or generated content to train AI models.
Kazi does not collect, identify, analyze, store, or create face data, face geometry, facial recognition templates, biometric identifiers, or biometric information.
5. User Responsibility for Content
You are solely responsible for the User Content you upload, submit, generate, edit, save, export, or share through Kazi.
You represent and warrant that:
- You own or have the necessary rights, licenses, and permissions to use the content you upload.
- Your use of the Service does not violate any law, third-party right, intellectual property right, privacy right, publicity right, or contractual obligation.
- You will not upload, generate, edit, or share content that is illegal, harmful, abusive, misleading, infringing, or otherwise prohibited by these Terms.
You should carefully review any AI-generated or edited content before using, publishing, or sharing it.
6. AI-Generated Content
Kazi uses Kazi AI to generate, edit, transform, enhance, and preview visual content based on your inputs.
AI-generated results may vary and may not always be accurate, complete, realistic, appropriate, or suitable for your intended purpose. You understand and agree that:
- Similar or identical outputs may be generated for different users.
- Generated content may contain errors, distortions, artifacts, or unexpected results.
- You are responsible for reviewing generated content before use.
- Kazi does not guarantee that generated content is unique, copyrightable, trademark-safe, commercially usable, or free from third-party rights.
- You are responsible for determining whether your use of generated content complies with applicable laws and third-party rights.
Kazi is not responsible for your use, publication, distribution, or commercialization of AI-generated content.
7. Prohibited Uses
You agree not to use Kazi to upload, generate, edit, save, share, or distribute content that:
- Violates any applicable law or regulation.
- Infringes intellectual property rights, privacy rights, publicity rights, or other third-party rights.
- Contains harassment, threats, hate, abuse, bullying, or discriminatory content.
- Impersonates another person or misrepresents identity, affiliation, or endorsement.
- Creates misleading, deceptive, fraudulent, or harmful content.
- Contains non-consensual intimate imagery or sexual exploitation.
- Exploits, harms, or endangers minors.
- Promotes illegal activities, violence, self-harm, or dangerous behavior.
- Attempts to create biometric identification, facial recognition, or identity tracking.
- Uploads private images of others without permission.
- Interferes with, disrupts, damages, or overloads the Service.
- Attempts to reverse engineer, scrape, copy, resell, or misuse the Service.
- Uses automated tools, bots, scripts, or other unauthorized methods to access or abuse the Service.
We reserve the right to remove content, restrict features, suspend accounts, or terminate access if we believe these Terms have been violated.
8. Subscriptions, Credits, and In-App Purchases
Kazi may offer paid features, subscriptions, credits, or other in-app purchases.
Purchases are processed through the applicable app store, such as Apple App Store or Google Play. Your purchase is subject to the payment terms, refund rules, and subscription policies of the relevant app store.
Subscription fees may renew automatically unless canceled before the end of the current billing period through your app store account settings.
Kazi does not directly control app store billing, refund processing, or subscription cancellation. Please manage your subscriptions through Apple App Store or Google Play.
Unless required by applicable law or app store policy, payments are non-refundable.
9. License to Use the Service
Subject to your compliance with these Terms, Kazi grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, access, and use the Service for lawful personal or permitted business purposes.
You may not:
- Copy, modify, distribute, sell, lease, or sublicense the Service.
- Reverse engineer, decompile, disassemble, or attempt to extract source code.
- Use the Service to build a competing product or service.
- Remove or alter copyright, trademark, or proprietary notices.
- Use the Service in a way that violates these Terms or applicable law.
10. Intellectual Property
The Service, including software, interface design, features, templates, effects, logos, trademarks, text, graphics, icons, and other materials, is owned by Kazi App Team or its licensors and is protected by intellectual property laws.
These Terms do not transfer any ownership rights in the Service to you.
You may not use Kazi’s name, logo, trademarks, or branding without our prior written permission.
11. Privacy
Your use of the Service is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, and protect information when you use Kazi.
By using the Service, you acknowledge and agree that we may process information as described in the Privacy Policy.
12. Content Review and Enforcement
Kazi may use automated or manual review methods to detect abuse, enforce these Terms, protect users, prevent misuse, and comply with legal obligations.
We may remove, restrict, or refuse to process content that we believe violates these Terms, our policies, applicable law, or platform requirements.
We are not obligated to monitor all content, but we reserve the right to take action when necessary.
13. Service Availability
We work to provide a reliable and useful Service, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
The Service may be affected by maintenance, updates, network issues, device limitations, technical failures, high demand, or other factors beyond our control.
We may modify, suspend, or discontinue all or part of the Service at any time.
14. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Kazi App Team disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.
We do not guarantee that:
- The Service will meet your expectations.
- AI-generated content will be accurate, unique, legal, or suitable for your intended use.
- The Service will be uninterrupted or error-free.
- Any defects or errors will be corrected.
- The Service will be free from harmful components.
You use the Service at your own risk.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Kazi App Team and its owners, employees, contractors, partners, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, content, goodwill, business opportunities, or other intangible losses.
This limitation applies to damages arising from or related to:
- Your use or inability to use the Service.
- AI-generated or edited content.
- Unauthorized access to your account or content.
- Service interruptions or errors.
- Third-party services, app stores, or login providers.
- Any conduct or content of other users.
To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to Kazi for the Service during the twelve months before the claim arose, or USD $50, whichever is greater.
16. Indemnification
You agree to indemnify, defend, and hold harmless Kazi App Team and its owners, employees, contractors, partners, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your use of the Service.
- Your User Content.
- Your violation of these Terms.
- Your violation of applicable law.
- Your violation of any third-party rights.
- Your misuse of AI-generated or edited content.
17. Account Suspension and Termination
We may suspend, restrict, or terminate your access to the Service at any time if we believe that:
- You violated these Terms.
- Your use may harm Kazi, users, third parties, or the Service.
- Your account is involved in fraud, abuse, illegal activity, or security risks.
- We are required to do so by law or platform rules.
You may stop using the Service at any time. You may request account deletion by contacting [email protected] or using the in-app account deletion feature if available.
Termination does not affect any rights or obligations that should reasonably survive termination, including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution provisions.
18. Third-Party Services
The Service may interact with third-party services, such as Google Sign-In, Sign in with Apple, Apple App Store, or Google Play.
Your use of third-party services is subject to their own terms and privacy policies. Kazi is not responsible for third-party services, payment systems, login providers, app stores, or their actions.
19. Changes to These Terms
We may update these Terms from time to time. When we make changes, we may update the “Effective Date” at the top of these Terms.
Your continued use of the Service after the updated Terms become effective means that you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service.
20. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the United States, without regard to conflict of law principles.
Where required by applicable law, you may also have rights under the laws of your country or region of residence.
21. Dispute Resolution
If you have a dispute with Kazi, please contact us first at [email protected] so we can try to resolve the issue informally.
To the fullest extent permitted by law, any dispute arising from or related to these Terms or the Service shall be resolved individually and not as part of a class action, collective action, or representative proceeding.
